Chinese display company expelled from US for stealing Samsung technology

In a lawsuit filed by Samsung Display, a subsidiary of Samsung Electronics, against its Chinese rival, BOE, the US International Trade Commission (ITC) has imposed a severe sanction on BOE, banning it from importing products into the US for a long period of time.

In October 2023, Samsung Display filed a lawsuit alleging that BOE had illegally misappropriated its trade secrets related to OLED technology.
Samsung Display has been investing hundreds of millions of dollars in OLED research and development since 1997, building up its technology, while BOE entered the market 16 years later than Samsung Display and began mass-producing large-scale products in a short period of time without showing any sign of conducting its own research and development. Samsung Display became suspicious of this and conducted an investigation, finding that BOE had illegally obtained trade secrets by hiring current and former Samsung Display employees and contacting suppliers that had done business with Samsung Display.

The ITC said, 'Despite Samsung Display's superior security measures, BOE improperly obtained and used trade secrets,' and 'caused substantial harm and serious threats to Samsung Display.'
The ITC issued a limited order banning BOE from importing products into the US for 14 years and 8 months. While this period is usually calculated based on the time required to eliminate profits gained through unfair practices, in this case it was calculated based on the development time of Samsung Display's core OLED technology, which reflects the difficulty and time required to develop OLED technology.
The ITC also ordered BOE's headquarters in China and its US subsidiaries to refrain from marketing or sales in the U.S. In addition, the judgment included a '100% deposit' measure, which would increase the import burden by raising the deposit to 100% when a measure allowing conditional imports by depositing a portion of the deposit during the review period following the final judgment was taken.

An industry insider pointed out, 'Sample products are necessary to conduct sales, but it's difficult now that imports are no longer possible,' and 'Potential customers will find it difficult to do business with BOE.'
According to the Chosun Ilbo, BOE held a 22.7% share of the small OLED panel market for iPhones in the second quarter of 2025, surpassing LG Display (21.3%). Until now, Apple has relied on Samsung Display as its main supplier and LG Display as a secondary supplier, but BOE's addition to the two was expected to erode Samsung Display's market share. However, with the ITC's final ruling now finalized, BOE's displays will no longer be used in iPhones, potentially benefiting Korean companies like Samsung Display and LG Display.
