The United States has been strengthening its regulations on Chinese companies, and has been enacting a bill to regulate TikTok, operated by the Chinese company ByteDance, due to national security threats. In April 2024, the Protecting Americans from Foreign Adversary Controlled Applications Act (PAFACA), also known as the TikTok ban law, was enacted.

The TikTok Ban Act includes a clause stating that 'if TikTok does not sell its business by January 19, 2025, TikTok's service provision and app distribution will be prohibited,' and distribution of the TikTok app was actually suspended on Google Play and the App Store on January 19, 2025. TikTok's service itself was also suspended on the same day, but the service itself was restored in a short time due to the efforts of President Trump, who was not yet inaugurated as president at the time. After that, President Trump signed an executive order on January 20, 2025, immediately after taking office, to postpone the enforcement of the TikTok Ban Act for 75 days. He signed a second enforcement postponement order on April 5, 2025, and a third enforcement postponement order on June 17, 2025.

A new Freedom of Information request has revealed that Attorney General Pam Bondi has sent letters to multiple technology companies stating that they can legally ignore the TikTok ban. The letters were sent on April 5, 2025, the same day as President Trump's second extension of the TikTok ban, and companies that received the letters include Google, Apple, Microsoft, Amazon, Oracle, Akamai, and LG.

Below is the letter that Attorney General Bondi sent to Google. Attorney General Bondi stated, 'President Trump has determined that the shutdown of TikTok violates our constitutional obligation to respond to U.S. national security and foreign affairs,' and argued that President Trump's order to postpone the TikTok ban was sufficient to fulfill that constitutional obligation.



In addition, Attorney General Bondi stated that 'if any company faces penalties related to the TikTok Ban, the Department of Justice will take steps, including intervening in litigation, to prevent those penalties from being enforced,' emphasizing to tech companies that 'there will be no consequences for ignoring the TikTok Ban.'



As mentioned above, Attorney General Bondi claims that President Trump has the authority to implement the TikTok ban, but Professor Jack Goldsmith of Harvard Law School said, 'Previous presidents have actively exercised their discretion in enforcing the law, but they have never completely suspended the operation of the law or waived penalties for violations of the law,' pointing out that President Trump's actions are an unprecedented overreach by any president. Professor Goldsmith also points out, based on a precedent from 1838 , that 'the Constitution does not give the president the power to ignore the law.'
